Background

San Jose’s ALPR Policy

San Jose states that ALPRs are used to enhance public safety by facilitating the identification and location of vehicles of legitimate interest to law enforcement. This includes locating stolen or wanted vehicles, apprehending suspects, finding witnesses and victims of violent crimes, locating missing persons, and crime investigations.

Officers are required to verify data and other sources before initiating contact with any vehicle.

  • Physical access is limited to law enforcement staff with a legitimate need to access the data
  • Access logs for searches are tracked (date/time, license plate, name/department of person accessing, purpose)
  • Periodic and random audits are conducted to ensure compliant with system requirements and law

In May of 2022, SJPD installed its first pilot program of ALPRs in an intersection notorious for hit and run collisions as well as fatal collisions.

Nick Hidalgo, a staff attorney for the NorCal ACLU, researched that San José’s ALPR program from 2022 showed that more than 99.99% of the plates scanned do not match any hotlists for police.
